Being regarded as having a limited immune system for more than six months is a protected class pursuant to Americans with Disabilities Act’s as Amended 2008 (ADAAA) at both 28 CFR § 35.108 (a) and 42 U.S.C. § 12102(3)(A) when the individual is subjected to a prohibited action because of an actual or perceived physical or mental impairment, whether or not that impairment substantially limits, or is perceived to substantially limit, a major life activity, even if the public entity asserts, or may or does ultimately establish, a defense to the action prohibited by the ADA.

Plaintiff is a qualified individual with a disability, pursuant to 28 CFR § 35.108 (a) and 42 U.S.C. § 12102(3)(A), and on the basis of disability, was subjected to discrimination in employment conducted by a public entity because Plaintiff was coerced to submit to weekly medical examinations when similarly situated school workers were not subjected to the same SARS-CoV-2 screening tests even though it was known that those similarly situated school workers could still become infected with SARS-CoV-2 and still transmit the virus.
230. Because the Health Order regarded Plaintiff’s immune system as limited for more than six months Plaintiff was qualified as disabled by being subjected to unlawful discrimination in employment and being denied the enjoyment of the benefits of employment provided by a public entity.
231. A benefit of employment denied from Plaintiff was a workplace free of discrimination based on disability.
232. A benefit of employment denied from Plaintiff was a workplace free of discrimination based on religion.
